[摘要]我国继承法在设计法定继承制度时,一方面受前苏联继承法的影响,另一方面受当时社会生产力不发达、财富较少等特殊国情的影响,于是便在确定法定继承人的范围和顺序时,不仅采纳了亲等继承制,而且又将养老育幼的理念增加进来.其结果在确立法定继承人范围的依据方面除了继受传统继承法所持的婚姻关系、血缘关系外,又添了养老育幼准则,由此具有了与众不同的特点.然而,比较近世各国继承法中法定继承制度的规定以及我国其他法域的相关规定,结合我国近几十年的司法实务和民事继承习惯,笔者认为,我国继承制度在重新起草时,应摒弃将养老育幼的理念作为确定法定继承人范围的依据,而当以婚姻关系、血缘关系基准为依据进行设计.

[Abstract] When the system of Legal Succession was being designed in the Inheritance Law of our country, on the one hand, it had been affected by that of the Soviet Union, on the other hand, was influenced by the special national conditions at that time, such as the underdeveloped social productivity, lacking of capitals and so on. Therefore, when the range and order of legal heir was established, it not only adopted the Degree Inheritance System, but also added into the concept of providing for the aged and bringing up the children. As the result, on the basic aspect of establishing the range of legal heir, it has not only remained the marital relations and genetic connections in the traditional law of succession, but also added the criterion of endowment and nurture, from which the distinguished characteristics were formed. However, comparing with the regulations of system of statutory succession of comtemporary laws of succession in other different countries, as well as the relevant provisions of other scope of law in our country, with the combination of the Judicial practice and Civil inheritance habit in the recent decades, I, as the author of this paper, believe that the concept of endowment and nurture as the basis of determining the Legal heir range shall be abandoned when the inheritance system of our country is to be rewritten. And it shall be designed in accordance with the marital relations and genetic connections. "
