21世纪是一个知识经济的世纪,对于知识的保护是前所未有的,特别是随着全球经济一体化的发展和经济竞争的日趋激烈,知识产权的竞争已成为国家和企业取得国际竞争优势的重要手段.虽然各国都对这种侵害知识产权的行为予以了严重的惩治,但由于知识产权救济制度本身还存在着各种各样的不足和漏洞,知识产权侵权行为反而变的越来越严重,国外如此,在我国同样也不例外,这就有必要对我国的知识产权救济制度予以研究,来保护知识产权权利人的利益,维护我国的经济发展的良好秩序.
本文将主要通过分析我国知识产权救济制度在司法实践和立法当中存在的不足,并结合国外在知识产权救济方面实施的制度,来更好地完善和建立合理的知识产权救济制度.

Abstract
The 21st century is a century of knowledge-based economy,the protection of knowledge is unprecedented,especially in the wake of global economic integration and economic development of the increasingly fierce competition,intellectual property rights,competition has become a national and international enterprises to obtain an important means of competitive advantage .Although all countries are the intellectual property rights to such acts against a serious punishment,but because of intellectual property relief system itself there are all kinds of gaps and loopholes,it changed the intellectual property rights violations more serious,so abroad,Similarly in China is no exception,which is necessary for China's intellectual property relief system to study,to protect the interests of intellectual property rights,safeguarding China's economic development in good order.
This paper will be mainly through the analysis of China's intellectual property relief system in which legislative and judicial practice of the deficiencies,and intellectual property rights of foreign relief in the implementation of the system,the better to improve and establish a rational system of intellectual property relief.
