无效婚姻制度是全国人民代表大会2001年4月28日修正并正式实施的《中华人民共和国婚姻法》中新增设的一项制度.这是新中国建国以来两部婚姻法都未涉及的问题,也是法学界多年来一直探讨、争论的话题.无效婚姻制度的确立,填补了婚姻法中的一项空白,也为执法部门处理违法婚姻提供了法律依据,是我国婚姻法制建设的一大进步.但不容忽视的是,修正后的《中华人民共和国婚姻法》对无效婚姻制度的具体规定还不够全面,还存在一些值得探讨的问题.本文试就婚姻无效制度的法律意义、婚姻无效的构成、宣告婚姻无效的程序以及婚姻无效的法律后果等方面作一个阐述,并对我国现行无效婚姻制度尚待改进之处提出自己的一些见解.
