摘要：在当今中国的刑事辩护领域,众多律师动辄被司法机关以《刑法》第306条之名入罪量刑,律师担任刑事辩护人之比率愈来愈低,人们在为这些律师扼腕痛惜之时,也为该法律条文之存废而多有争论.通过分析,该法条在立法技术层面存在犯罪主体范围过小、犯罪情节描述模糊,以及与相邻法条衔接空白或竞合、与《律师法》相关条文冲突等缺陷；在立法价值层面,则于立法理念与立法原则方面都存在缺陷.因此,笔者主张取消该法条,并完善《刑法》相关法条,同时确立律师刑事豁免制度和证据开示制度.他律之外更须自律,律师队伍本身也要不断提高素质.
