3.2 Particular causes of duty crime
Besides the above common reasons, there are some particular reasons of duty crime.
Firstly, the position of some officers supplies a necessary condition for duty crime. As officials have authority or duty to do something directly, they are convenient to crime at their professional privilege. Therefore, duty crime in our country is relative to the corrupted working style, which makes duty crime at every vocation has its own character.
Secondly, all sorts of temptation have seduced officials. As duty means to make decision on something, it must cause all kinds of temptations attempting to impact on the decision or power. A person who are in all kinds of entice are more easily to duty crime than not. It can be taken as a balance. Once the weights of two sides are different, the center of gravity will lose its balance and the scale will slant to the weightier. For example, some cadres take the power which the people given as the chip to get their self-interest. They take the chance that they have the power to distribute the material, exam and approve item, debit and credit capital etc. to do transaction of power with money. There is no way when they didn’t receive money, vise versa.
Thirdly, duty criminals are not fear of punishment on account of the strong supporter. The criminals rely on the coercive force of state to support convenience for their crime behaviors. This is one of important reasons of duty crime. Because the officials indicate country to operate their power, they have the chance to use public office for private gain, retaliate or frame somebody. Besides, they have the whole strong coercive force of state to support themselves; they will have a blind sense of proud. Thus, these criminals think that they are above others, look down on everyone or everything, abuse their authorities, and act wildly against law and public opinion. It leads to duty crime, which impinges citizen’s democratic right or personal right. For example, some person thought they are elite or great officer, or have great contribution to the development of economy, thus they can do what they want.
Fourthly, the concealment of duty crime makes criminals have fluke mind. People always confidentially crime, which makes them think their behavior won’t be noticed by others. Thus, the criminals will relieve their fear of punishment and commit crime stick at nothing.
