Except as provided in Section 10,XXX’s liability on any claim whether in contract,tort (including negligence in any degree),warranty,strict liability,or otherwise for any loss or damage arising out of,or connected with a Deliverable or this Agreement shall in no case exceed the License Fees allocable to the Deliverable,or in case the Deliverable is included in a Package,the License Fees allocable to the Package which gives rise to the claim paid or due to it pursuant to this Agreement.
